Terms & Conditions

These Terms and Conditions (“Terms”) together with our Privacy Policy govern your use of the www.opi.com/en-GB website and your relationship with OPI UK (“we” or “us”) and set out the legal terms and conditions on which we sell any of our products to you. Please read these Terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these Terms, please contact us to discuss.

If you do not agree to these Terms, please do not register for or use the www.opi.com/en-GB website. By ordering any of our products you agree to be bound by these Terms. Nothing in these Terms affects your statutory rights.

These Terms apply to consumers only. If you are not a consumer then please see below for the terms which apply to you. We amend these Terms from time to time. Each time you wish to order products please check these Terms to ensure you understand the Terms which will apply at that time.

Every time you order products the Terms in force at that time will apply to the contract between us.

These Terms were last changed on 8th December 2021.

The OPI UK website is owned and operated by WELLA UK&I LTD (company number 12857361) whose registered office is at 7th Floor, St George’s House 5 St George’s Road, Wimbledon, London, United Kingdom, SW19 4DR.

How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

“Writing” includes emails. When we use the words “writing” or “written” in these Terms, this includes emails.

 SHOPPING WITH OPI UK

You can order products online via this website only.

When you place an order for a product in any of the ways described above you are offering to buy it for the price stated, subject to these Terms.

When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order and all orders are subject to availability. Your order (including payment) is an offer to buy from us, so nothing we do or say will amount to any acceptance of that offer until we actually send the product to you. You must pay for products before we dispatch them.

If we are unable to accept your order we will inform you of this in writing and will not charge you for the product. This might be because we do not ship to your country or because we have a system issue that means we are unable to process the order correctly. If you have already paid for the products we will refund you the full amount as soon as possible. This does not affect your Statutory Rights.

The images of the products on our website are for illustrative purposes only.

Please note that the packaging of our products may vary from images on our website.

OUR RIGHTS TO MAKE CHANGES

We may change the product to reflect changes in relevant laws and regulatory requirements.

We may update these Terms from time to time and these changes will apply to the use of www.opiuk.com and any orders you place on the website after the Terms are updated.  If you do not wish to accept the new Terms you should not continue to use www.opi.com/en-GB. If you continue to use www.opi.com/en-GB after the date on which the change comes into effect, your use of www.opi.com/en-GB  indicates your agreement to be bound by the new Terms.

PRICE

The price for each product will be displayed on the order pages where you place your order and is shown UK sterling and includes VAT at the applicable rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.

We always try to make sure that the prices on www.opi.com/en-GB are accurate but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full. Prices for our products may change from time to time but changes will not affect any order which has been dispatched or for which we have issued a dispatch confirmation. Please note that if a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing then we may cancel your order, refund you any sums you have paid and require a return of any products provided to you.

You will be notified of the delivery costs automatically before you submit your credit or debit card details, based on the delivery address you specify.

PAYMENT

Orders may be processed online, using a credit or debit card (Amex, Maestro, Electron, Solo, Visa, Delta and Mastercard). To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet. Payment for the products and all applicable delivery charges is in advance of dispatch. Please note that payment must be cleared before your order can be dispatched.

Please also note, when taking payments over the phone we can only accept Amex, Visa and Mastercard.

SECURITY

We use Shopify payments, a company with the latest security measures to protect your details when you shop with us.

If you look up at the URL of the shopping basket page you will notice that it begins with https://. This means that it is on a Secure Server and all transactions that take place are encrypted between your browser and the server. Nobody is able to obtain your credit card details nor other information. Of equal importance is the security which surrounds the payment system. By making use of Shopify payments we have a sophisticated online trading system available. It allows us to safely process your credit card payment with the bank, and complete the financial transactions securely behind protected firewalls.

No personal or financial details are left unencrypted on a remote server, and such details are never sent by internet email.

Your credit card company may also do security checks to confirm it is you making the order.

All order details and invoices will be sent with your goods to the delivery address that you specify at the point of placing your order.

DELIVERY AND CHARGES

All orders will be delivered within 30 days after the day on which we accept your order. No orders are processed, dispatched or delivered on Bank Holidays or weekends. For detailed info on Delivery of Goods and Postcode Exceptions click here.

If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery or collect the products from a local depot.

If after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and refunding any money you have paid in advance but we may deduct reasonable compensation for the net costs we incur as a result of breaking your contract.

A product will be your responsibility from the time we deliver the product to the address you gave us.

You own a product once we have received payment in full.

COMPLAINTS

We welcome all feedback about our service and we aim to deal with any problems or difficulties experienced by our customers both quickly and fairly. We have a simple but comprehensive returns and refunds policy which means that we can get to the bottom of most queries quickly and easily over the phone. For issues that cannot be dealt with immediately we will endeavour to respond within 24 hours either with a solution or with an expected timescale to put an end to the issue. AVAILABILITY OF PRODUCTS

We try to keep www.opi.com/en-GB  as up to date as possible but cannot guarantee that particular product will always be available.

All offers are available while stocks last. If we are unable to supply a product you have ordered, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you the money you have paid for it.

We try and offer you the best service we can. But we cannot promise that all our products and services will meet your requirements and we cannot guarantee that opiuk.com will be fault free. If you find a fault, please let us know by emailing us by clicking here.

There will be some times when your access to the www.opi.com/en-GB  website is restricted to allow for repairs, maintenance or improvements.

LIABILITY OF OPI UK

The OPI UK website is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Internet. If we are informed of any inaccuracies in the material on www.opiuk.com we will try to correct them as soon as we can.

In particular we are not liable to you for the following:

  1. Incompatibility of www.opi.com/en-GB with any of your computer or telecommunications equipment or software

  2. Technical problems or errors or interruptions of www.opi.com/en-GB 

  3. Inadequacy of www.opi.com/en-GB to meet your requirements

  4. To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (included but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss or privacy or loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related www.opi.com/en-GB 

Nothing in the above paragraph applies to liability in respect of products sold through www.opi.com/en-GB 

If we fail to comply with these Terms we are responsible for loss or damage that you suffer that is a foreseeable result of our breach of these Terms or our negligence but we are not responsible for any damage which is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.

We only supply the products to you for domestic and private use. You agree not to use the products for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; and for defective products under the Consumer Protection Act 1987PROPRIETARY RIGHTS

The content of www.opi.com/en-GB  is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content www.opi.com/en-GB on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on www.opi.com/en-GB  without written permission from us.

No license is granted to you in these Terms to use any trademark or service marks of OPI UK or its licensors including, without limitation, the trade marks, or service marks.

PRIVACY

We are committed to protecting your privacy. We will only use your personal information as set out in our Privacy Policy – https://www.wellacompany.com/privacy-policy

GENERAL

Please read the instructions, manuals and other user documentation that comes with your Products carefully. You are urged to use all Products safely and in accordance with the guidelines.

We may change or withdraw any part of www.opi.com/en-GB , or may refuse you access to the web site at any time if we consider it necessary.

We may also immediately remove, cancel or suspend access to and use of www.opi.com/en-GB  upon breach of any part of these Terms whatsoever. This shall be without prejudice to OPI UK’s other rights.

We may transfer our rights and obligations under a contract with you to another organisation, but this will not affect your rights or our obligations under these Terms.

We act as principal on our own account and not as agent for you or any other person.

If We do not enforce any provision of these Terms such will not be considered a continuing waiver.

In the event that any part of these Terms is held to be unenforceable, such part will at our option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

These Terms constitute the full agreement between you and OPI UK and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.

Our website is solely for the promotion of our products in the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the UK. Since we only operate within the UK market, we cannot guarantee that our website accords with local laws of any other countries.

Use of OPI UK and these terms are subject to the laws of England & Wales and the jurisdiction of the English Courts. This means a contract for the purchase of products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

OFFERS & DISCOUNTS

YOUR RIGHTS TO END THE CONTRACT

Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract:

  1. if what you have bought is faulty or misdescribed you may have a legal right to end the contract (or to get the product replaced or to get some or all of your money back) (see the section headed FAULTY / INCORRECT PRODUCTS);

  2. if you want to end the contract because of something we have done or have told you we are going to do (see below);

  3. if you have just changed your mind about the product. You may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions and you will have to pay the costs of return of any products (see the section headed RIGHT TO CHANGE YOUR MIND).

If you are ending a contract for a reason set out at (a) to (d) below the contract will end immediately and we will refund you in full for any products which have not been provided and you may also be entitled to compensation. The reasons are:

  1. we have told you about a change to the product which you do not agree to;

  2. we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed;

  3. there is a risk that supply of the products may be significantly delayed because of events outside our control;

  4. you have a legal right to end the contract because of something we have done wrong.

You can end the contract for any reason as set out in (a) to (d) above by contacting us by telephone on 02039 015892 or email us on UKI.opicso@wella.com to inform us that you wish to return the goods and we will allocate you with a returns code.  We ask that you send the items back to us via Royal Mail First Class (recorded) and include a proof of postage from the Post Office so that we can refund you for your return postage costs.

RIGHT TO CHANGE YOUR MIND

For most products bought online you have a legal right to change your mind within 14 days after the date you receive the products and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in this section.

Please note that you do not have the right to change your mind in respect of products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.

You have 14 days after the date you receive the products to tell us that you have changed your mind about the products. You can do this by contacting us by telephone on 02039 015892 or email us at UKI.opicso@wella.com.

If you choose to cancel the contract we will refund you any money (including delivery charges) which you have paid us for that product by the method you used for payment. However, we may make deductions from the price, as described below.

If you are exercising your right to change your mind:

  1. We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

  2. The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer.

We will make any refunds due to you as soon as possible. If you exercise your right to change your mind then your refund will be made within 14 days from the day on which we receive the product back from you or, if earlier, the day on which you provide us with evidence that you have sent the product back to us.   Please note you must pay the costs of return. If you choose to return your order we will refund you cost of goods (excluding delivery charges) once goods have been returned to the warehouse. Note that volume per item must not exceed 30ml and no more than four items in any one parcel. Some items might be prohibited by certain couriers. FAULTY / INCORRECT PRODUCTS

As a consumer you have legal rights in relation to products which are faulty or not as described. We are under a legal duty to supply products that are in conformity with this contract. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect those legal rights.

If you receive an item from us which is faulty/broken or which you did not order, please contact us by telephone on 02039 015892 or email us at UKI.opicso@wella.com to inform us within 30 days of purchase and we will arrange a refund including any applicable delivery charges or a replacement. In the event of you returning goods to us we will also pay you the reasonable cost of the return postage. Please contact us prior to returning the items and we will allocate you a returns code and we will advise you how to send or whether to send the items back to us. To enable us to deal with your return as efficiently as possible, you will need to detail the returns code on any correspondence relating to the return procedure, including the package of returned goods. We ask that you send the items back to us via Royal Mail First Class (recorded) and include a proof of postage from the Post Office so that we can refund you for your return postage costs.
